New Birth Injury Website Launched to Aid in Lawsuit Determinations

A new website has been launched called the Birth Injury Resource Center where individuals whose children have been injured at birth can see about new legal birth injury updates and medical information regarding birth injuries. The resource can help one who is contemplating bringing a birth injury lawsuit and can help one get in touch with a birth injury lawyer. The website also helps to distinguish between hospital lawsuits versus lawsuits against physicians for doctor mistakes during the birthing process. Litigation may be a good course of action for one to take to receive monetary awards after they have suffered personal injuries from a hospital mistake. To see this new website click here.

Dennis Quaid Settles Birth Injury Suit for $750,000

The hospital that gave Dennis Quaid’s twins a lethal dose of Heparin has settled with the family for $750,000. The hospital gave the babies a 10,000-milliliter unit dose of Heparin, a blood thinner, made by the Baxter Healthcare Corp. instead of the prescribed 10 milliliters immediately after the twins were born. The twins struggled for their lives after the lethal overdose of Heparin almost killed them. Fortunately, the twins survived the overdose administered by the healthcare providers at the hospital. A petition filed in the court shows that the Quaids and the hospital have agreed on the parents’ damages, but can still pursue birth injury claims for their children. Tumor found after baby’s birth shocks doctor

A doctor operated on a 3 day-old baby after an MRI showed a tumor after birth on the newborn’s brain. While the doctor removed the growth, he realized it contained a nearly perfect foot, the formation of another foot, a hand, and a thigh. The doctor said that this type of birth injury is extremely unique and unusual.

Paxil birth defect warning too late for some children

A woman had three children, but two were born with birth complications. The complications were quite possibly Paxil-related birth defects. The mother was taking Paxil during both pregnancies. The first son was born four weeks early and the second was born six weeks early. In 2005, the FDA issued a public health warning about Paxil – placing it in its second highest category of drugs known to cause birth injuries.

A Physician’s Examination of Several Birth Injuries

The incidence rates of stillbirths and infant deaths have been examined in a recent study created by a Physician at Rochester General Hospital. The Physician determined that 2% of infant deaths occur due to significant birth injuries. Birth injuries may have long term affects however some birth injuries, usually due to physician’s errors during birth, have little if any long term affects. The physician’s report discusses some birth trauma and birth injuries such as: Cephalhematoma, Brachial plexus injury, cranial nerve and spinal cord injuries. To read the full study click here.

March of Dimes issues 2008 Premature Birth Report Cards

The March of Dimes recently graded states by comparing each state’s rate of premature birth to the nation’s objective of 7.6 percent or less. Premature babies often suffer birth injuries. The nation, as a whole, and Illinois specifically, received a “D.” You can sign the Petition for Preemies online, urging for change to prevent premature births and birth injuries.

Case Law Update: Expert Testimony Not Needed in Birth Injury Case

Thornton v. Garcini, No. 107028 presented the question as to whether record contained sufficient evidence to support jury's verdict in favor of plaintiff in action alleging negligent infliction of emotional distress arising out of death to plaintiff's son during child birth. While defendant argued that expert witness testimony was necessary to prove instant claim, Appellate Court found that, unlike medical malpractice claims, expert testimony was not necessary to establish severity of plaintiff's emotional distress. This third district decision will have a great impact on birth injury decisions.

Birth Injuries Caused by Group B Streptococcal Infection

Every year approximately 7,600 cases of neonatal group B streptococcal (“GBS”) infections occur in newborns in the United States. A fetus who is exposed to GBS organisms in utero and develops early-onset infection may suffer from serious complications which include brain damage, pneumonia, meningitis, and a chronic lung disease known as bronchopulmonary dysplasia. GBS is the leading bacterial organism responsible for causing the death of newborns who develop early-onset infection. Most newborns who develop early-onset GBS infection are born to mothers who have GBS bacteria in the vaginal rectal areas at or around the time of labor an delivery. Even though between 10-30% of pregnant women are colonized with GBS bacteria, most of them have no symptoms and do not know that they are colonized. A pregnant woman should have a doctor perform cultural samples for distal vagina and anorectum. It should be noted that not all infants exposed to the GBS bacteria will become infected. However, because GBS can produce severe consequences, including death and irreversible brain damage it is necessary that pregnant women check for the bacteria. To read the full story, click here.

Twin undergoes revolutionary treatment for birth injury

A twin who experienced a brain birth injury is about to undergo an experimental treatment. The surgery uses her own umbilical cord blood. The birth injury victim is now four years old. While her twin sister hit all of her developmental milestones early, the 4 year-old birth injury victim did not learn to crawl until she was three.
