Newborn Suffered Permanent Brain Damage During Delivery – Lawsuit Filed

The birth of a child should be a joyful occasion, however, for one Cook County mother, the delivery proved to be traumatic. The woman claims in a lawsuit that her daughter experienced permanent brain damage due to lack of oxygen during labor and delivery. The baby suffered fetal asphyxia and seizures, according to the lawsuit. The woman is seeking damages of more than $50,000 as well as legal fees.

Fetal Asphyxia is Dangerous
Fetal asphyxia is the lack of oxygen to the baby that occurs during the labor or birth process. In this case, the woman was given an epidural, which caused her blood pressure to drop to dangerous levels. According to the paperwork, the fetal monitor was disconnected for a period of 68 minutes, during which time the baby was deprived of oxygen for a period. Fetal asphyxia may cause mild to severe injuries or death. The infant in this case suffered permanent brain damage as a result of oxygen deprivation. The child will likely require constant care and her quality of life will be greatly reduced.

Dangers during Childbirth
Childbirth usually proceeds without incident; however, sometimes there are complications. Complications during labor and delivery can be serious and may cause life-threatening injuries to the baby. The lack of oxygen to the baby during delivery is certainly one of the most dangerous concerns. The baby cannot be without oxygen for any period of time. When oxygen is limited or cut off completely, the child will suffer some type of harm. Brain injuries may range from mild to severe. Sometimes the child will recover almost completely while other times the oxygen deprivation was long enough to cause permanent brain damage. The child may suffer from cerebral palsy, developmental disorders, or organ failure.

Birth Injuries
Whenever a child suffers an injury during birth the situation is heartbreaking for the family. There are many things to think about at this traumatic time. Of course, it is essential to provide the best medical treatment necessary for your child, yet this can be overwhelmingly expensive. If a child has suffered a permanent injury, as in this case, the parents will need to provide ongoing care and treatment that must last a lifetime. Over many years, these costs may be astronomical. Parents need help paying for these expenses and the child deserves money for his or her loss of enjoyment of life. These costs or damages are a direct result of the negligent medical treatment that caused the child’s injury.

Negligent Medical Care
Sometimes medical mistakes are made during the labor and delivery of a baby. Unfortunately, when a birth injury occurs it often has devastating results. If an infant suffers an injury during birth because of the negligence of the doctor or medical professionals, it is likely considered medical malpractice. Parents of infants who were severely injured or have died as a result of medical mistakes may be entitled to collect damages. This would include such things as current and future medical expenses, rehabilitation costs, money for pain and suffering, and compensation for loss of enjoyment of life, among others.
