Misdiagnosis of Pregnancy Condition Leads to Abortion, Lawsuit

Pregnancy is supposed to be a happy time for couples as they begin to plan for their future families. For one couple, however, the pregnancy took a tragic turn when the doctor diagnosed an ectopic pregnancy and the pregnancy was ended. Later it was learned that the pregnancy was normal after all and the abortion was not necessary. The couple has filed a lawsuit in Cook County alleging negligence against MetroSouth Medical Center, Pronger Smith Medical Care, and the doctor. The lawsuit seeks damages of more than $50,000.

Ectopic Pregnancy

Most pregnancies develop normally, inside the uterus. Unfortunately sometimes the woman experiences an ectopic pregnancy. An ectopic pregnancy is one where the fetus attaches inside the fallopian tubes or somewhere else other than inside the uterus. The fetus cannot survive in this position and if left alone the mother can experience serious physical harm and possibly even death. Therefore, when a woman has an ectopic pregnancy it should be ended quickly before any damage occurs. This is typically done with a chemical injection or with a procedure called a dilation and curettage (D&C).

Misdiagnosis Led to Abortion

The woman in this case underwent the abortion based on the doctor’s diagnosis of an ectopic pregnancy. After the procedure was performed the pathology report indicated that the pregnancy was intrauterine, inside the uterus normally. Thus, the woman ended the pregnancy only because of the misdiagnosis. Of course we trust that our doctor provides us with the best possible care and has our best interests in mind at all times. This time the doctor was, according to the lawsuit, negligent by improperly diagnosing the ectopic pregnancy.

Medical Malpractice

Medical malpractice occurs when a doctor or other medical professional make a mistake. Doctors are held to a high standard of care and are expected to do so because of their education, training, and experience. They must take time to ensure that they make the correct diagnosis, especially when it comes to pregnancy. In this case, the couple would not have ended the pregnancy except for the misdiagnosis made by the attending physician. The lawsuit alleges that the doctor acted negligently by making the improper diagnosis. The error likely caused both physical and emotional damage to the couple.

Birth Injuries and Medical Malpractice

In this case the doctor performed an abortion because of a mistake. In other cases, mistakes are made during the labor and delivery of a baby. These errors can cause serious physical harm to the infant. Some of the most common birth injuries include brachial plexus injuries, bone fractures, asphyxia, spinal cord injuries, and cerebral palsy.
