The birth of a child is usually one of the most joyful times in a parent’s life. Yet sometimes something goes wrong and the happiness turns to dismay and sorrow. A woman from Riverdale recently filed a lawsuit in Cook County for negligence in the severe injuries her child sustained during birth. The lawsuit alleges that the doctor and hospital were negligent and the child suffered distress and injury as a result. The lawsuit seeks damages in excess of $50,000.
Birth Injury Negligence
Birth injuries can happen from time to time because of the negligence of the doctor or other medical staff. Doctors are expected to provide a high standard of care because of their education, training, and experience. When this does not occur it may be due to a mistake. The use of forceps at birth can cause a brachial plexus injury, which could cause long-term motor skill issues. Other, less severe injuries may happen during the birth process which could include broken bones and bruising.

The mother in this case has filed a lawsuit to seek justice for the serious injuries to her child. Typical lawsuits in situations such as this one offer an option to receive compensation for damages. Damages could include money for medical bills, compensation for pain and suffering, and the funds needed to provide ongoing medical and physical care for a seriously injured child. The lawsuit in this case does not indicate the extent of the infant’s injuries; however, we can be sure that the baby did suffer seriously since he was in distress.
